David A. Cutner, Esq

David Cutner is an attorney engaged in the practice of Elder Law and Estate Planning.  His law firm, Lamson & Cutner, P.C., has offices in New York City and Westchester County.  David believes that an effective estate plan should be integrated with a plan for health care and long-term care, which for most people is their greatest financial risk.

Early in his career, David was an Assistant United States Attorney in the Southern District of New York, where he prosecuted securities fraud and tax fraud cases.  After government service, he founded a law firm that served a business and commercial clientele.

While building a successful law practice, David’s attention was frequently diverted to dealing with health care issues for his mother, who suffered with growing problems from dementia.  During this time, he dealt with hospitals, home care agencies, nursing homes, and Medicaid.  These experiences were a significant factor in leading David to transition into a law practice devoted to representing the elderly and disabled, and to the founding of Lamson & Cutner.

David is a member of the New York State Bar Association Elder Law and Special Needs Section, where he serves on the Executive Committee and as Chair of the Unauthorized Practice of Law Committee.  He does a lot of public speaking on Elder Law and Estate Planning topics at senior centers, public libraries, and houses of worship. He also gives continuing education courses to health care professionals.  Lamson & Cutner was the first law firm, and remains one of very few, that has been accredited by New York State to provide continuing education credits to licensed social workers and care managers.

David loves the outdoors, and particularly enjoys sailing and skiing. He and his family spend much of their leisure time on their sailboat, which is named in memory of his mother.  He lives with his wife and son in Westchester County, New York.
